However, none of the changes will impose additional obligations on you with respect to actions taken before the change took effect, unless you had already agreed to such changes. If we make any changes to these Terms of Use, we will post our updated Terms of Use on our website and the changes will be effective immediately on posting, unless indicated otherwise. Description of the Products
Fig offers installment loans and services related thereto through merchants with term options and interest rates varying based on the purchase price and other criteria (“
Fig Products
"). Fig Products are only available in those provinces and territories in Canada where they may be legally offered.
Collection of Personal Information
To offer you the Fig Products, we need to process your personal information. Furthermore, throughout your application process for a Fig Product, you may be asked to provide banking details which will allow Fig, or a third party mandated by Fig, to confirm your identity, pre-fill your application and complete certain forms and contracts. It is your responsibility to review documents between you and your financial institution to ensure that you are entitled to provide us with login information and that you understand the consequences of such disclosure and liability that may result therefrom. By using our website, mobile or online services, portal or application or applying for Fig Products, you acknowledge and are providing express consent for Fig to collect, use, process and disclose your personal information and have received our Privacy Statement which describes in more detail and information on how we use and protect your data. Our Privacy Statement is incorporated by reference to these Terms of Use.
Your Obligations
You agree to provide only true, accurate and complete information and not misrepresent your identity or account information. It is your responsibility to keep account information up to date and accurate at all times with Fig.
Indemnification
You agree to indemnify, defend and hold Fig, its affiliates, directors, officers, employees, agents and representatives harmless from any liability, including reasonable legal fees, related to any violation by you or your authorized representative of these Terms of Use.
Trademarks, copyrights and other rights
You should assume everything on our websites, mobile or online services, portal or application is protected by and subject to applicable copyright, trademark and patent or other intellectual property rights unless otherwise noted and may not be used except with the express written consent of Fig. Certain names, products, technology, service, logos, graphics, designs, words, phrases or the like may constitute trade names, trademarks or service marks (collectively

) owned by Fig. Any such right that is not expressly licensed herein is reserved by us. Images of people or places displayed on our websites, mobile or online services, portal or application are either our property or used with permission by us. Use of these images by you or other third parties is prohibited unless expressly permitted by us or such third party that may own the image. Nothing contained on our websites, mobile or online services, portal or application should be construed as granting by implication, estoppel or otherwise, any license or right to use any Trademarks displayed on this site without the written permission of us or such third party that may own the Trademarks. No content from our web pages, mobile or online services, portal or application may be posted to newsgroups, electronic bulletin boards, mail lists or incorporated into any other site without our express written consent.
